Scope

This Policy explains how we collect, use, disclose, and protect personal information under Australia’s Privacy Act 1988 (Cth) and the APPs; and, where relevant, EU/EEA GDPR, UK GDPR, and California CCPA/CPRA.

Personal information we collect

• Account & membership data: name, display name, email, password (hashed), role, plan tier, renewal dates.
• Donations & payments: billing name, email, country, transaction IDs, last4 and card brand from processors; we do not store full card numbers.
• AI portal & site usage: prompts, outputs, usage counts/limits, feedback, IP address, device/browser info, cookies, analytics events, error logs.
• Communications: messages via forms, email, event registrations.
• Optional research data: if you opt in to trials or studies.
• Wallet/crypto: public wallet address and on‑chain references you provide.

How we use personal information

• Provide and administer memberships, donations, invoices, and access to paid features.
• Operate the Totaphysics AI portal (usage tracking, abuse prevention, rate‑limit enforcement, improvement).
• Communicate about programs, courses, publications, events, and support.
• Improve the Services (analytics, debugging, security monitoring, A/B testing).
• Meet legal/financial obligations (tax records, fraud prevention, sanctions screening where required).

Legal bases (GDPR/UK where applicable)

• Contract — to provide memberships, donations, and AI access you request.

Payments

Payments are processed by third parties (e.g., Stripe/PayPal) under their terms and privacy notices. We receive limited payment metadata and retain receipts for tax/compliance.

Disclosures and international transfers

We keep records as long as needed. Financial records are typically retained for 7 years. AI usage logs may be retained for security; when no longer needed, we de‑identify or delete them.

• EU/UK: access, rectification, erasure, restriction, portability, objection, and withdrawal of consent.
• California: know/access, delete, correct, and opt‑out of certain “sales/share” (we do not sell personal information as defined by CCPA/CPRA).

Security

2. Changes

We may modify these Terms by posting an updated version. Continued use constitutes acceptance.

3. Eligibility & Accounts

You must be capable of forming a binding contract and comply with applicable laws. Keep credentials confidential and notify us of unauthorised use.

4. Memberships, Donations, Billing

• Prices, features, and limits are shown at checkout and may change prospectively.
• Recurring plans renew automatically until cancelled. Cancel before the next renewal to avoid future charges.
• Refunds: Donations are non‑refundable unless required by law; membership refunds are discretionary and limited to undelivered service periods.

5. Totaphysics AI Portal – Acceptable Use

• Do not break the law, infringe IP, violate privacy, or submit unlawful content.
• Do not reverse engineer, scrape, overload, or bypass rate limits/usage caps.
• Do not represent outputs as medical, legal, engineering, or other professional advice without independent verification.

We may suspend/terminate for abuse or security risk.

6. Content & Intellectual Property

All site content, logos, and trademarks are owned by us or our licensors. You receive a limited, non‑transferable licence to access and use the Services for personal or organisational, non‑exclusive purposes. Do not copy, resell, or create derivative works without permission.

7. User Submissions

By submitting content (messages, forms, research materials), you grant us a non‑exclusive, worldwide licence to host, process, and display it for operating and improving the Services. You represent you have necessary rights and your content doesn’t infringe others.

8. Third‑Party Services

Links and integrations (Stripe/PayPal, analytics, embeds) are governed by those providers’ terms and privacy notices. We are not responsible for third‑party services.

9. Disclaimers

The Services are provided “as is” and “as available.” Outputs from AI systems are probabilistic and may be inaccurate or incomplete.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Our aggregate liability for claims relating to the Services will not exceed the greater of AUD $100 or the amounts you paid in the 3 months preceding the claim.

11. Indemnity

You agree to indemnify us against claims arising from your misuse of the Services or violation of these Terms.

12. Governing Law & Disputes

These Terms are governed by the laws of Queensland, Australia. Parties will first attempt good‑faith negotiation; failing that, disputes go to the courts of Queensland.

1) Scope

This policy covers memberships, donations, event registrations, digital content/services (including Totaphysics AI), and any physical merchandise we may offer.

2) Memberships & subscriptions

• Cancel anytime from your account → Subscriptions. Access continues until the end of the paid term.
• We generally don’t offer prorated refunds for unused time. We correct billing errors (duplicates, unintended renewals) and comply with consumer laws.
• Trials/intro offers: cancel before the trial ends to avoid charges.

3) Donations

Donations are typically non‑refundable. We will review requests related to payment error, fraud, or unauthorised use.

4) Digital content & AI services

Digital services are delivered immediately. Where local law (e.g., EU/UK) provides a withdrawal right, you may be asked to consent to immediate supply and acknowledge that the withdrawal right may be waived once access begins.

5) Events

Refunds or transfers follow the event’s terms. If we cancel or materially change an event, you’ll be offered a refund or alternative.

6) Physical goods (if any)

Eligible returns require items unused and in original condition within 30 days of delivery, unless a different period is specified by law. Refunds exclude shipping unless the item is faulty.

7) Crypto payments (if enabled)

Crypto payments are final due to network design. In rare cases of clear error or failed delivery, we may issue a make‑good in the same token, net of gas/fees, once funds are verified.

8) How to request a refund or cancellation

Email akiyakiyaiyaboko@gmail.com with: name, email, order/subscription ID, date, amount, and reason. Approved refunds are processed to the original method; banks/processors typically settle within 5–10 business days (varies).

9) Chargebacks

Please contact us first—we can usually resolve issues faster than your bank. Unresolved disputes may be contested with documentation.
